Policy
What follows is a continuation of the policy (Adopted 4.2009)
VIOLATIONS AND PENALTIES
(This revision is in Final Review.)

In order for policies to be effective, procedures for enforcement are essential for the preservation of User Rights and the organization's community mission. WPAA COMMUNITY BUILDING TV is authorized to issue warnings and suspensions to Users and will do so in writing stating the violation and penalty.

Certain User actions are consider Major Violations and will result in an immediate 90-day suspension of all User privileges.

These include, but are not limited to:

  • Abuse of staff and other Users.
  • Commercial or profit-making use of facilities or resources.
  • Misrepresentation of Users affiliation with WPAA
  • Falsifying forms.
  • Taking equipment without authorization.
  • Conduct of any illegal activity at the WPAA facility
  • Certain User actions are consider Minor Violations and will result in a written warning or possible suspension of facility or resource use. User behaviors seen as patterns with multiple occurrences over time or collectively will be reviewed for suspension action.

    These include, but are not limited to:

  • Entering areas posted as off-limits.
  • Abuse of equipment, including attempted repair. Changing wiring, connections or attaching accessories without staff authorization.
  • Failure to cancel a reservation in a timely manner.
  • Late return of, or missing or damaged equipment.
  • Any mishandling or tampering with any WPAA equipment.
  • Smoking in WPAA facility.
  • Failure to clean-up after using the facilities.
  • Failure to proper credit submitted programs.
  • Failure to comply with 1st Use distribution.
  • APPEAL PROCESS

    Users are encouraged to resolve difficulties directly with WPAA Board. If an appeal is not resolved with WPAA the USER can appeal to CACSCC. [If the issue came to WPAA through the Council the Board is encouraged to include the local advisors and/or CACSCC officers directly in the appeal process.]

    The process and timeline is summarized as follows:

    Upon receipt of a User complaint action will be taken by staff or a board member with consult with at least one board member following the action outlined for either the major or minor violation. Written notice of the complaint and the action will be sent to the offending User. The notice will either state the next meeting date of the Board or advise the offending User that a meeting can be requested to be held within next meeting 15 days. If there is an Appeal the Board will consider the Users position. If there is no Appeal the Board will ratify the action of staff or board member.

    TERMS

    Address: A physical or mail location or virtual address represented by a web site name.

    Community Access Program: A media program developed with video and/or computer equipment. Most are made by Users of Community Access Facilities like WPAA. Others have non-commercial content of deep interest to User/Viewers. Programs with political content are treated like all other programs. Any program that is not produced by a Community Access Producer must have a Wallingford resident Guarantor to be distributed by WPAA.

    Credits: References in a media program that acknowledge contributions to the production. Contributors include but are not limited to: WPAA, talent, crew, host, copy write permissions for audio and graphic sample by title & producer, sponsors that provide financial support including in-kind services or materials. Credits will appear at the end of a program unless production value dictates an alternative placement; however, sponsorship can only be credited at the end of a program. Credits should not appear to identify participants or sponsors in a manner that can be considered advertising.

    Distribute/Distribution: WPAA supports distribution of media programs on designated cable and video channels authorized by federal and state regulation. WPAA also supports video streaming. As of 2009 this includes Comcast-Cable, ATT U-verse Video and V-Brick Internet Streaming.

    Narrowcasting: The WPAA service territory is Wallingford. Cable TV viewing is limited to Wallingford, Video TV viewing is selectable by Wallingford designation and streaming has most likely appeal to Wallingford residents temporarily located out-of-town. So ‘narrow’ compares to ‘broad’ cast with the idea that Wallingford viewers and topics are central to the policy interpretation.

    Suspension: Notice to a User that they are not welcome at the WPAA facility or not eligible to reserve the facility or equipment or not eligible to schedule Community Access Programs for distribution or any combination thereof for a designated period of time subject to any results of Appeal. Confirmation of Suspension is made by the Board. Staff can activate an instant suspension of 2 week in urgent situations based on verbal review with any members of the Board that is available for consult. A User may request in writing a meeting with WPAA Board in order to appeal and/or resolve the suspension.

    User: A person 18 years of age or older contracting by signature on designated forms to use WPAA resources, or a person identifying them self as a viewer of WPAA distributed programs. User access to resources can have a dependency on residency in Wallingford, employment or schooling in Wallingford or the six towns of Branford, East Haven, Guilford, No. Branford, No. Haven or Madison. Users agree to have their identity maintained in WPAA records which are available for inspection as required by state regulations.



    For Political Season

    WPAA Political content is treated like all other content. Producers have equal access to resources and User staff support.
    Completion of appropriate forms is required.

    State of CT Chapter 289 Sec16-331a

    The following rules and guidance for Community Access Channels exist in CT LAW.

      SCHEDULING:
      Adopt a policy that provides for conflict resolution such that a fixed distribution schedule will not exceed 13 weeks if sought by another User and a substantially similar time slot does not resolve the conflict.

      Safe Harbour allowed.

      CONTENT:
      No editorial control for non-commercial Public, Education and Governemnt programming.

      No obscenity.

      Encourage program diversity with outreach and policy.
